BOARD OF TRUSTEES MEETING
MONDAY NOVEMBER 19, 2001

The regular monthly meeting of the Ann Arbor Charter Township Board of Trustees was called to order by Supervisor Langford at 7:35 p.m. at the Township Hall, 3792 Pontiac Trail, Ann Arbor, MI 48105.

Present: Supervisor Elizabeth Langford, Clerk Catherine Braun, Treasurer Virginia Forshee, Trustees John Allison, Della DiPietro, Richard Dieterle, Michael Moran. Also present Attorney Sandra Sorini, Engineer Roger Gaugler, Zoning and Building Inspector Gary Dresselhouse, Fire Chief Rick Ericson.

Public Comment John Petz, Domino's Farms spoke in reference to the proposed Zoning Ordinance Amendments referencing period of time required for disposition of petitions to the Planning Commission and Township Board.

K. Srinivasan spoke about the proposed Ave Maria Golf Course by reading his letter to the Board dated November 19, 2001.

William Koeppel spoke of his support for the Mother House on Warren Road and also the proposed Ave Maria Golf Course.

Amend Agenda Moran moved to amend the agenda to add under Item V-A - KLB/Popkins School Performance Bond and move other items down. Dieterle supported and motion carried.

Approval of Minutes DiPietro moved approval of the October 15, 2001 minutes. Allison supported and motion carried. DiPietro moved approval of the October 22, 2001 minutes. Allison supported and motion carried.

Zoning Ordinance Amendments Allison moved approval of Zoning Ordinance amendments (1) Article XXV.130.2503 Amendment Procedure, Section 25.03, Subsection C (2) Article XI 130.1115 Planned Unit Development. Section 11.15, Subsection D.l Procedure for petition and area plan approvals, Subsection c. (3) Article XXI Conditional Uses. 130.2106 Planning Commission Action Section 21.06 (4) Article XXI Conditional Uses. 130.2107 Township Board Action Section 21.07 (5) Article XXII Site Plan Review. Section 130.2203 Preliminary Site Plan. Subsection D. (6) Article XXII Site Plan Review. Section 130.2204 Final Site Plan . Subsection D. Dieterle supported.

Zoning Change for Mother House from A-1 to PUD Cheryl Zuellig, Smith Group JJR, Constantine Pappas and Evans Caruso from the Architect Firm were in attendance to answer any questions that board members might have and to seek approval of the PUD Rezoning and Area Plan for the Motherhouse at 4597 Warren Road. Members would like some additional language be inserted in the Resolution and to scale the project down slightly. Moran.moved to table. Allison supported and motion carried.

Private Road Ordinance Allison moved approval of the Private Road Ordinance first reading with changes. Dieterle supported and motion carried.

Dawson Annexation Allison moved to table the Douglas C. Dawson annexation of 2 adjoining parcels on Geddes Avenue for additional information. Moran supported and motion carried.

Proposed Ordinance for Farmland Preservation Karen Hertenstein spoke regarding the Ann Arbor Township Farming and Farmland Preservation Committee Interim Report dated November 15, 2001.This report contained three recommendations. Otto Moehrle spoke about drain tiles and outlets that directly affect his property. Moran moved Recommendation #1 We establish an ordinance so we would be able to participate in a PDR program. Recommendation # 2 Like to see Ag Preservation Committee recommend a geographic area that they think is a specific concern. They come up with recommendations for preservation or requiring repair of disrupted drain tiles and make it a civil infraction if it isn't done with appropriate penalties. Recommendation # 3 Ask attorney to research methods of reducing or eliminating the property tax on actively farmed land, especially keeping in mind and following the bills in front of the State Legislature. Dieterle supported and motion carried.

Performance Bond - Popkins School Moran moved approval of the $100,000.00 Bond That Cunningham-Limp Company will make the public improvements and do the work with the plans, specifications and provisions for the completion of the work on the Popkins School and that they will continuously work till work is done as long as weather permits. Braun supported and motion carried.

Financial terms of Sprint and Nextel Jon Barnard of UAS for Sprint and Mark Morris for Nextel were in attendance to answer any questions. Allison moved approval of the financial terms of the Wireless Communications Site Agreement - $1750.00 per month for rent, $8,000.00 for one time processing fee and $3,000.00 for attorney's fees. Moran supported and motion carried.

Washtenaw County Sheriff Department Contract Undersheriff Mahoney and Commander Southworth were in attendance to discuss the Washtenaw County Services Contract between the County and Ann Arbor Charter Township. Moran moved to approve the contract for four deputies with the clarification of the responsibility for deputies in Article V, correct typo in Article VI, take out reference to substation in contract, take out language on life threatening situation. Allison supported and motion carried.

Gabriel Richard High School - Whitehall Blvd. Dennis McGowan Hobbs & Black Associates, Harry Iwasko Legal Council Diocese of Lansing, Barbara Olson Business Manager Gabriel Richard High School, Bill Laurain Construction Manager Etkin-Skanska and Phil Carroll Washtenaw County Road Commission were in attendance to discuss Whitehall Blvd roadway plans. Moran moved to table Whitehall Blvd. Road Agreement. Allison supported and motion carried.

Gabriel Richard High School Fire Services Agreement Dipietro moved approval of the Fire Protection and Services Agreement between Carl F. Mengeling, Roman Catholic Bishop of the Diocese of Lansing, a Michigan Corporation and Ann Arbor Charter Township with an annual payment of $12,000.00 and each year on the anniversary of the commencement date, shall be capped at 3% or less depending on the C.P.I. as determined by the State Treasury. Allison supported and motion carried.

Historic District -2426 Whitmore Lake Road Brian and Linda Etter were in attendance to request there home at 2426 Whitmore Lake Road be designated as a Washtenaw County Historic District. Dieterle moved support of the request. Allison supported and motion carried.

DF Land Development meeting date on Ave Maria Golf Course Moran moved to table for consideration of the Ave Maria International Golf Club at our next regularly scheduled board meeting on December 17, 2001. DF Land agreed to delay a decision to the 17th meeting date. DiPietro supported. Motion carried with Allison opposed.

Allison moved that the Supervisor and Clerk provide the board with a letter of explanation why a copy of the DNR report was not presented to the board and a solution for solving this problem in the future. Moran supported and motion carried. With DiPietro adding that the Planning Commission also be included.

Wine Making - Liquor License - 165 Stein Road Moran moved to deny the request for a liquor license by Joseph Thomas, 165 Stein Road. It is a nonconforming parcel per 130.1004 A-1 required lot area. Dieterle supported and motion carried.

Claims Listing DiPietro moved approval of the claims listing for November 1, 2001 in amount of $307,379.78 and November 14, 2001 in amount of $34,641.74. Forshee supported and motion carried.

Fire and Safety No report.

2002 Meeting Dates Dieterle moved approval of the meeting dates for 2002, January 21, 2002, February 18, 2001, March 18, 2002, April 15, 2002, May 20, 2002, June 17, 2002, July 15, 2002, August 19, 2002, September 16, 2002, October 21, 2002, November 18, 2002, December 16, 2002. DiPietro supported and motion carried.

Planning Commission: The minutes for the October 8, 2001 and November 5, 2001 were included in our packets.

Forshee moved to adjourn, DiPietro supported and motion carried.
